Kessel Holdings LLC pays the listing fees for this ACTIVE EBAY AD - for ONE Reason only, to PROTECT the NEW, Less Experienced, and Return Client of eBAY Florida Residental Lots from Sellers of PORT CHARLOTTE, FLORIDA Residential Lots - who consistently list on eBay questionable lots, who require the BUYERto PAY for the lot before offering TITLE INSURANCE and who do NOT offer TITLE INSURANCE when settling the Closing with an independent CLOSING AGENT.
Review this Excerpt from the Charlotte County Clerks Office on Tax Deeds:
Do I get a clear title with a Tax Deed? All properties sold at a Tax Deed Sale qualify under Buyer Beware. The purchase of a Tax Deed Saledoes not warrant or guarantee clear and marketable title.
Take Note. Most title companies require the property to go through a quiet title lawsuit before issuing title insurance for any property bought at Tax Deed Sales.
What liens or encumbrances survive against a property after it is sold at a Tax Deed Sale? Governmental liens and judgments survive the issuance of a tax deed and are satisfied to the fullest extent possible with monies from the sale.
Governmental liens that are not satisfied in full with monies from the sale, survive the issuance of a tax deed and continue to be recorded against the property.
** The Buyer, the Future Owner cannot obtain a BANK FINANCED LOAN to Build on the Tax Deed acquired Lot, unless a clear Title can be obtained and verified. Beware that these sellers may offer Title Insurance With Exceptions to Coverage in the Title Insurance Policy. Standard exceptions are routine in every policy, BUT exceptions entered for lots sold at tax deed sales are UNIQUE AND PARTICULAR and are not standard or routine. Carefully review exceptions in Schedule B2 of the title policy to ensure you review and note the items that are exempted and as a result NOT COVERED by the Title Policy.
Based on these TITLE INSURANCE POLICY EXCEPTIONS, Bank Finance Loans cannot be obtained to build on the Tax Deed Lot(s) acquired from sellers subscribing to such practices.
DO NOT committ to BUY and PAY for ANY Florida Lot without SELLER provided Title Insurance, BEFORE FINAL Settlement Payment at the CLOSING. Request that your closing agent or attorney explain any exceptions noted in Schedule B2. Do Yourself aFAVOR and CALL your TITLE COMPANY, local LAWYER or REAL ESTATE ATTORNEY and ask for their PROFESSIONAL Opinion before acquiring any FLORIDA LOT without TITLE INSURANCE offered by the Seller or if the seller OFFERS TITLE INSURANCE WITH NON-STANDARD EXCEPTIONS NOTED IN SCHEDULE B2. Get Answers before closing and settling the purchase. Be informed and make the right decision for your situation.
Kessel Holdings LLC has specialized in eBay Sales of Port Charlotte Lots for more than 15 years and has many satisfied repeat buyers. We are here to stay and we are committed to educating our clients on the practices (good and bad) used by eBay Sellers of Florida Lots.
We have a vesed interest in the practices employed and want to ensure that
1. Serious potential and repeat Buyers are NOT mislead when considering a Purchase for immediate use or for short or long term Investment 2. An Informed and Fair Market is maintained on eBay to ensure the conduct of sincere and reputable business processes.
Anytime economic downturn is experienced, sellers without integrity list on eBay, and new buyers with little or no experience enter the eBay market, we have seen an increase in Buyers who were not adequately informed about "low end" Lots on eBay. These Buyers paid in excess of $3,000 - $6,000 for lots acquired at Tax Deed sales for under $2,000.00 witout a Marketable Title Insured Deed. Many of these sellers will routinely offer inferior quality TAX DEED LOTS, surrounded by roads not maintained and badly paved. Many of these lots are also adjacent to or surrounded by old and small 1950 homes giving the appearance of an ecominimally depressed neighborhood - negaively impacting the resale value of these lots. Also beware if no homes are build ajacent to or in the surrounding neighborhood - in this case, the lots are locaed in an Undeveloped Section of the the county (the county does not regularly maintain existing roads in an undeveloped section).
Also, ensure that the parcel IS NOT located in an ENVIRONMENTALLY SENSITIVE SCRUB JAY bird area. Frequently such lots require very EXPENSIVE SPECIAL PERMITTING to allow building and and in many cases permission to build cannot be obtained. ALWAYS ask if the lot you are purchasing is situated in an Environmentally Sensitive Scrub Jay area. MANY Lots in Port Charlotte CANNOT be build on for this specific reason.
BEWARE of SELLERS who routinely purchase lots very cheaply at Public Tax Deed Auctions and DO NOT disclose this information when listing on eBay. Buyers of these lotswill be immediatley at a disadvantage and often have to pay legal fees in the thousands to complete a Suit to Quiet Title. This process can take up to a year or longer to complete and in some instances the lot cannot be cleared at all.
We have seen and are still following many of the sad and horrific Buyer Stories - when new or inexperienced Florida Lot Buyers fall victim to a Seller who endorses the "Quick Buck Trend," Bying and Selling such inferior lots.
How Do I Know? When a seller offers only a Special Warranty Deed or a Quit Claim and no IMMEDIATE Title Insurance to protect YOUR investment - Beware.
The SELLER offers TITLE INSURANCE ONLY at YOUR EXPENSE and the Title Insurance must be purchased AFTER the SALE is final and closed - Beware.
Our foremost concern is to protect and educate the eBAY Buyer and explain the potential problems that follow when purchasing lots WITHOUT TITLE INSURANCE; when purchasing from SELLERS who are Not completely forthcoming and who DO NOT explain the possible ramifications. Many such SELLERS require FULL PAYMENT before the BUYER has had time to consult with an independent TITLE COMPANY to complete a $100.00 TITLE SEARCH that would provide valid TITLE INSURANCE. Remember, the average TITLE INSURANCE POLICY Fee is only $100.00.
Make it a PRACTICE to carefully READ the ENTIRE eBay Auction Listing and the FINE PRINT, to determine if and what type of DEED is offered by the Seller. Learn if the Seller settles the Closing through a reputable 3rd party TITLE COMPANY paid by the SELLER, and if the TITLE INSURANCE is provided to the BUYER for review before to CLOSING. Stay Informed
Environmentally Sensitive - Cannot be build
Take another look!
Sellers likely offer "Title Insurance with Tax Deed and Environmentally Sensitive Lots."
In all or many instances, Environmentally Sensitive Lots, such as lots designated as Scrub Jay lots, are not buildable - no matter how beautifully or perfectly located they are. Similar to Tax Deed lots (or a combination of the two designations): Alwasy do a thorough research to protect buyer's interests.
We offer and sell only Non Scrub Jay Properties
